Has SLC Competent Authority’s post become Unconstitutional?

After Harin Fernando has taken over as Sports Minister, the post of Sri Lanka Cricket Board (SLC) Competent Authority Kamal Padmasiri has become unconstitutional, a top lawyer of the island has said to Cricket Age.

After the exit of Thilanga Sumathipala led administration on May 31st, then Sports Minister Faizer Mustapha had appointed his secretary Padmasiri as the competent authority to run the SLC. Since then, Padmasiri was looking after day to day affairs of the SLC.

However, after Harin Fernando arrival, Padmasiri appointment has automatically become unconstitutional.

“At the time of his appointment on 1st June, Kamal Padmasiri was the permanent secretary of then Sports Minister Faizer Mustapha. However, now as Faizer is no more a minister, Padmasiri has been reappointed as the secretary to the Ministry of internal and home affairs and provincial Councils, local government. So, now being a different ministry secretary, how can remain as the competent authority of SLC” Sri Lanka’s Attorney at Law Panduka Keerthinanda said.

Now, W. A. Chulananda Perera has been appointed the secretary of Sports Ministry.

“Now the present Minister must cancel his appointment with a another Gazette and appoint an Interim committee under Sports law 25 0f 1973, section 33 and publish a new Gazette” Panduka further added.

Moreover, according to Sri Lanka’s Sports law, before appointing an interim committee, Sports Ministry will have to remove Padmasiri as SLC Competent Authority!
